These Terms & Conditions (“Terms”) govern your access to and use of rscmaine.com (the “Website”) and the purchase of any products from RSC Maine (“RSC Maine,” “we,” “us,” or “our”). By accessing this Website or purchasing our products, you agree to be bound by these Terms.

By using this Website, placing an order, or purchasing any product from RSC Maine, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you may not use the Website or purchase our products.

All products sold by RSC Maine are intended for use by trained and qualified operators. Heavy equipment attachments are inherently dangerous if improperly installed or operated. The buyer assumes all responsibility for:

• Proper installation
• Equipment compatibility
• Safe operation
• Compliance with applicable laws, regulations, and safety standards

RSC Maine makes no representation that its products are suitable for consumer, household, or untrained use.

All product descriptions, specifications, weights, dimensions, and images are provided for informational purposes only and may be approximate.

Buyer is solely responsible for verifying:

• Compatibility with their machine
• Hydraulic requirements
• Weight limits
• Mounting interface and dimensions

RSC Maine is not responsible for damage, injury, or loss caused by improper fitment, misuse, modification, or failure to verify compatibility.

• All prices are listed in U.S. Dollars (USD).
• Payment is required in full prior to fabrication or shipment unless otherwise agreed in writing.
• We reserve the right to refuse or cancel any order at our discretion.
• Errors in pricing or descriptions may be corrected at any time.

Many RSC Maine products are custom-built or fabricated to order.

Custom or made-to-order products are non-cancelable and non-refundable once fabrication has begun.

All lead times provided are estimates only and are not guaranteed. RSC Maine shall not be liable for delays caused by, but not limited to:

• Material shortages
• Supplier delays
• Freight or carrier issues
• Labor issues
• Acts of God or force majeure events

RSC Maine is not responsible for downtime, lost profits, or job delays due to lead time changes.

• Risk of loss transfers to the buyer upon shipment from RSC Maine’s facility unless otherwise stated in writing.
• Buyer is responsible for unloading freight unless explicitly stated otherwise.
• Freight damage must be noted on the delivery receipt at the time of delivery and reported immediately.
• Failure to note damage may void any freight claim.

RSC Maine provides a limited warranty against defects in welds

 for a period of [6] months from the date of delivery, unless otherwise stated in writing.

This warranty:

• Does not cover wear items, normal wear, abuse, misuse, improper installation, overloading, or modification
• Does not cover labor, downtime, or transportation costs

This limited warranty is the sole and exclusive warranty provided.

EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

RSC MAINE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

To the maximum extent permitted by law:

• RSC Maine shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, downtime, or business interruption.
• RSC Maine’s total liability shall not exceed the purchase price of the product giving rise to the claim.

Buyer agrees to indemnify, defend, and hold harmless RSC Maine from any claims, damages, losses, or expenses arising from:

• Use or misuse of products
• Improper installation
• Modification of products
• Failure to follow safety guidelines

All content on this Website, including product designs, drawings, photos, logos, and text, is the property of RSC Maine and may not be copied, reproduced, or distributed without written permission.

These Terms shall be governed by and construed in accordance with the laws of the State of Maine, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the courts of the State of Maine.

RSC Maine reserves the right to update or modify these Terms at any time. Continued use of the Website or purchase of products constitutes acceptance of the revised Terms.
